2. Purpose
These Terms and Conditions govern the sale of downloadable digital products (photo and video mockups) offered on the website www.theeditorialgallery.com.
Any order implies full acceptance of these Terms and Conditions.
3. Products
The products offered are downloadable digital files.
Product visuals displayed on the website are for illustrative purposes only and are non-contractual.
The customer acknowledges that they are purchasing digital content and not a physical product.
4. Prices
Prices are indicated in euros (€), VAT included.
VAT is not applicable pursuant to Article 293B of the French General Tax Code.
The seller reserves the right to modify prices at any time.
The applicable price is the one displayed at the time of purchase.
5. Orders
The customer selects the product and the appropriate license.
Before finalizing the order, the customer:

Expressly waives their right of withdrawal for digital content
The order becomes final upon confirmation of full payment.
6. Payment
Payment is made online through the payment methods available on the website.
The order is validated once full payment has been received.
7. Delivery
Products are delivered exclusively via digital download.
Access to the file is provided after payment confirmation.
No physical product will be shipped.
8. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code:
The right of withdrawal does not apply to digital content supplied on a non-physical medium once performance has begun with the consumer’s prior express consent and acknowledgment of the loss of the right of withdrawal.
By completing the purchase, the customer:

Agrees to immediate download

Expressly waives their right of withdrawal
No refund may be requested once the download has begun.
9. Intellectual Property
All mockups are protected by copyright law.
The purchase grants a non-exclusive right of use according to the selected license.
No transfer of intellectual property ownership occurs.
Any reproduction, resale, redistribution, or use not compliant with the license is strictly prohibited.
10. License Terms
The conditions of use are defined in the “License” section available on the product page.
The license is non-exclusive, non-transferable, and valid for one legal entity only.
If a client wishes to use the mockup in their own name, they must purchase their own appropriate license.
11. Liability
The seller shall not be held liable for:

Improper use of the product

Software incompatibility

Use not compliant with the license

Indirect damages resulting from the use of the mockup
Liability is limited to the amount paid for the order.
12. Force Majeure
The seller shall not be held liable for failure or delay in performance resulting from events beyond reasonable control, including but not limited to natural disasters, technical failures, internet outages, hosting provider failures, or cyberattacks.
13. Consumer Mediation
In accordance with French Consumer Code provisions regarding consumer dispute mediation, after having contacted us and failing to receive a satisfactory response, you may refer the matter free of charge to the following consumer mediator:
